The following are examples of results obtained by the firm in specific cases. Every case is different and the facts and law in each case may dictate a different result. Medical malpractice/Wrongful death

Johnson County District Court (2006) – We are presently co-counsel in a case involving hospital negligence and nursing negligence where Client suffered third-degree post-operative burns from a heating pad negligently applied by nursing staff.

Wyandotte County District Court (2004) – We were co-counsel in wrongful death case alleging hospital negligence and psychiatric malpractice in case where our 16-yr. old Client committed suicide at a State-run psychiatric hospital. Although jury ultimately found psychiatrist not liable for Client’s death, we successfully negotiated settlement with State of Kansas due to negligence of its agents.

Commercial collections

Douglas County, Kansas (2006) – We successfully resisted a mortgage foreclosure action against Clients for long enough to give them time to refinance their mortgage and save the equity in their home – Case dismissed.

Johnson County, Kansas (2006) – We obtained a $43,000 judgment against contractor on behalf of Client, a small businessman painting subcontractor.

Johnson County, Kansas (2005) – We assisted a small contractor in recovering $9,500 debt owed by realty executive for remodeling job by filing a mechanic’s lien and a lien foreclosure action. We recovered 96% of Client’s claim.

Wyandotte County, Kansas (2005) – We assisted a small business/construction supplier to recover on a $15,000 debt owed on a construction job by filing a mechanic’s lien and a lien foreclosure action. We recovered 75% of Client’s claim.

Johnson County, Kansas (2003) – We successfully negotiated settlement of suit against restaurant Client for collection of past-due rent and termination of lease, allowing Client to pay past-due balance over time. We saved Client’s lease, and restaurant remains in business at same location.

Douglas County, Kansas (2003) – We obtained a $675,778.00 jury verdict as co-counsel in a breach of commercial lease case. (Case later overturned on appeal.)

Sedgwick County, Kansas/Pittsburgh, Pennsylvania (1999) – In Kansas state court action and Pennsylvania arbitration case, we pursued collection of $78,000 debt owed on Pennsylvania construction job. We recovered 54% of Client’s claim.

Wyandotte County, Kansas (1999) – We pursued collection of $66,000 debt owed to a construction supplier on a construction job. We recovered 96% of claim, forcing defaulting contractor into bankruptcy.

Wyandotte County, Kansas (1997) – We recovered 96% of claim of a construction supplier against independent contractor sales representative who had withheld monies owed to company.

Consumer protection cases

Miami County, Kansas (2001) – We obtained judgment for $115,400 actual damages and $115,400 punitive damages against a contractor who had taken monies from a family on contract to build house and who later abandoned the project.

Johnson County, Kansas (2000) – We defended a mobile home seller in an consumer protection investigation by District Attorney into Client’s alleged defrauding elderly woman in $100,000 scam. No charges filed – No consumer protection violations.

Johnson County, Kansas (1998) – We obtained a judgment against an auto dealer for $25,000 plus attorney fees for misrepresentations made to Client during her purchase of a classic Corvette. We collected $7,500 from dealer insurance bond. Dealer went out of business.

Civil rights cases

United States District Court, Kansas City, Kansas (2005) – We defended a Client who alleged violated neighbor’s civil rights by using racial epithets and allegedly burning neighbor’s shrubs. We participated in mediation of the Plaintiff’s claim, resulting in a meeting of the minds in neighbor dispute, settlement and dismissal of claim.
